
TERMS AND CONDITIONS OF ONLINE SALEE
Article 1 – Scope of Application
All our sales are governed by these general terms and conditions of sale, which prevail over any purchasing conditions, unless expressly stipulated otherwise.
Article 2 – Orders
2-1 Placing and preparing orders.
Orders are placed online or by mail to the following address:

Once the order is received, it becomes irrevocable.
The customer specifies the method of payment (credit card or bank transfer).
The customer receives an email confirming the order.
2-2 Product unavailability
The seller undertakes to fulfill the order within the limits of available stock. In the event of a stock shortage, the seller will offer the customer a product of equivalent quality and price. In the absence of agreement, and in the event of the customer’s withdrawal, a refund will be issued in accordance with Article L 121-20-1 of the French Consumer Code.
2-3 Right of withdrawal
Under Article L121-20 of the French Consumer Code, the customer has a period of FIFTEEN clear days to exercise their right of withdrawal without having to justify reasons or pay penalties, except for the return shipping costs if applicable. This period begins upon receipt of the goods.

Article 3 – Delivery
3-1 Delivery method and times
Packages are delivered by carrier to the address indicated during the order.
(Service details: We inform the customer that the Colissimo service enables products to be delivered throughout mainland France within 48 to 72 hours after shipment. Delivery times are provided for information purposes only and do not engage our responsibility.)
For international shipments, delivery times vary depending on the destination country.
3-2 Delivery address
In the event of an address change, the parcel recipient must inform the company at the time of ordering.
3-3 Delivery delays
We undertake to deliver your order within 21 days. In the event of failure to deliver within this period, the seller will refund the order in accordance with Article L 121-20-1 of the French Consumer Code.
Optional Article 3-4 – Geographical delivery area
Example wording: The delivery area for products sold on the site only includes mainland France and for sales required within these geographical areas.
3-5 Risks
The transfer of risks for products sold by our company occurs when the products are handed over to the carrier.
3-6 Transport
In case of damage to or shortage of delivered goods, the customer must make all necessary reservations with the carrier by registered letter with acknowledgment of receipt within 3 days of receipt, in accordance with Article L.133-3 of the French Commercial Code. A copy will be sent to us at the same time.
Any product not subject to reservations will be considered accepted by the recipient, and our company will be released from any liability.
3-7 Product storage
For optimal storage of the product, it is recommended to store the bottles lying down in a cool place.
Article 4 – Prices
Our prices are indicated inclusive of all taxes in euros and are those in effect at the time the order is placed.
For shipments within France, the invoiced price includes shipping costs. The shipping costs listed on the site apply only to mainland France.
For other countries, shipping costs are billed based on the destination country.
Unless otherwise agreed, payment is made when ordering. No discount will be granted for early payment. According to legal provisions, any payment made after the due date indicated on the invoice will result in late payment penalties equal to three times the legal interest rate. These penalties are due without the need for a reminder. Additionally, all collection costs will be borne by the buyer.
Article 5 – Payment terms
The price is payable immediately and in full when ordering by the following methods:
— by check when ordering;
— by credit card in euros to the company’s account, whose details will be provided at the time of the order.
The order is validated once payment is confirmed.
Article 6 – Retention of title
In accordance with Article L 624-16 of the French Commercial Code, the goods remain our property until full payment is made.
Article 7 – Disputes
The company’s registered office is the place of domicile for any disputes.
Contracts concluded by a French consumer from France are governed by French law. The seller’s regional court will have exclusive jurisdiction.
Contracts concluded by a consumer ordering from another EU country are governed by French law, with disputes referred to the appropriate jurisdiction in accordance with EU rules, notably the Brussels Convention of September 27, 1968.
Article 8 – Waiver
If our company does not invoke any clause of these terms at a given time, this shall not be construed as a waiver of the right to invoke the same clause at a later date.
Article 9 – Protection of personal data
In accordance with Article 27 of Law No. 78-17 of January 6, 1978 (“Data Protection Act”), the customer has the right to access, rectify, modify, and delete personal data concerning them.

Article 10 – Archiving and proof
The data stored in the company’s database serves as proof of the orders placed, except in the event of an obvious error, for which the customer must provide proof. The customer, having the possibility to verify the accuracy of the data entered, assumes sole responsibility for any non-receipt or loss of ordered goods due to an error.
Article 11 – Intellectual property
All elements of the website are and remain the intellectual property and exclusive property of the seller. No one is authorized to reproduce, exploit, distribute, or use any part of the site, whether visual or audio, for any purpose, even partially, without the express written consent of the seller.
Simple or hypertext links are strictly prohibited without the seller’s express written consent.

Article 13 – Warranty and liability
All products supplied by the seller come with the legal warranty provided for in Articles 1641 and following of the Civil Code.
In the event of product defects, the customer must comply with the conditions set out in Article 1648 of the Civil Code.
The seller, in the online sales process, is only bound by an obligation of means. Thus, they may exonerate themselves from all or part of their liability by proving that the failure or improper performance of the contract is attributable either to the customer, to the unpredictable and insurmountable act of a third party to the contract, or to a case of force majeure.
Article 14 – Protection of minors
In accordance with Article L.3342-1 of the French Public Health Code, which prohibits the sale of alcohol to minors, the customer and the recipient commit to being over eighteen years of age at the time of ordering.
